The following information must be observed in connection with acceptance of cargo to Gabon. All shipments MUST have a valid BIC BEFORE loading, or at latest 5 days afterwards (click here to see the format of the BIC document), the only exceptions are where there is no CGC agent mandated for the country - please see the list below.
The Gabonese government collects fees from cargo owners to increase state income. The collection is handled by the CGC (Conseil Gabonais des Chargeurs - the Gabonese Shippers Council) and the fee covers the issuance of a BIC (Bordereau d'Identification de Cargaison, a cargo declaration certificate). The CGC cannot refuse to issue a BIC, and it is therefore not a "waiver" in the real meaning of this word. Failure to produce a BIC will result in an immediate penalty levied on the shipping line that has brought in the cargo. The fine is normally 75 - 100% of the value of the cargo in question, and cannot be appealed. Often we are fined months or even years after the shipment arrived as the CGC can request us to provide the document long after the container is released. In this case, if we have no document, we are fined, the point being that we will pass on the fine to the shipper. If we do not pay the fines we risk losing our agency licence.
It is absolutely crucial that you confirm that the shipper is organising the BIC BEFORE you accept the container for loading - a BIC dated more than 5 days after the cargo load date is not valid. The BIC number MUST be mentioned in the B/L and the manifest. If we note that a container is arriving without a valid BIC number we may refuse to discharge it in Gabon.
The BIC is obtained by the shipper or his forwarder by filling in the required CGC form with cargo details and submitting it to the CGC or its appointed agents (see the list below). The head office of the CGC is in Libreville, Gabon, and handles all local inquiries and requests. The CGC has appointed AGENTS in other areas as per the list below. If the shipment originates in an area NOT covered by any of the CGC agents on the list below, no BIC is required, and a "Derogation Speciale" is done in Gabon by the consignee. Fines are not levied if the cargo originates from a location not covered by a CGC agent. If cargo from an origin covered by the CGC arrives in Gabon without a BIC, the CGC will issue a "Derogation Speciale" which is used for clearance but is also the trigger for the fine. There is NO WAY of securing a BIC at destination.
